TeCSA is a strong supporter of ADR. Most TeCSA members have experience of advising clients on mediation, and many of them also act as mediators.
TeCSA provide the following essential resources for resolving disputes by mediation and other ADR methods:
In the event that you have agreed to mediate with a third party but cannot agree on the identity of the mediator, the Chairman of Tecsa will appoint a mediator from its list. If you would like to know more about this service, please contact the Chairman
Recent Developments/News:
Judges as mediators
TeCSA has been actively involved in the public discussions regarding the proposal that TCC judges should offer their services as mediators in appropriate cases (called the Court Settlement Process). It has to be said that TeCSA is not overly enthusiastic about this idea, because of the very different training and approach that is required to make a good mediator nevertheless it is believed that so far nine cases have been successfully mediatied by a TCC judge. TeCSA will continue to monitor progress with the Court Settlement Process with interest and an open mind. Further information is available here. Please send any information and comments about your experiences with the Process to Charles Gardner at cec.gardner@ntlworld.com
