Technology and construction disputes almost invariably require the use of expert witnesses, on technical, quantum, programming/planning matters and other subjects. TeCSA members are therefore frequent users of expert witnesses and are in a good position to suggest to their fellow practitioners suitable experts in particular disciplines. Tecsa pioneered the use of an Expert Witness Protocol, to set out clearly what where the responsibilities of expert witnesses and those instructing them. Since then, the need for TeCSA's own protocol has been overtaken by the Civil Justice Council's Protocol, applicable to all kinds of litigation.

We will be conducting a survey of members relating to the use of single joint experts and the issues that arise in this area. We hope that in due course this may be helpful to members in making submissions to the court for or against the appointment of single joint experts.
