Review of the Construction Act

In March 2004 the Chancellor announced in his budget speech in that the Government would be re-examining the adjudication and payment provisions contained in the Housing Grants, Construction and Regeneration Act 1996. TeCSA has been highly active in the review of the Act which was prompted by this announcement

TeCSA had representatives on each of the Working Groups working under the chairmanship of Sir Michael Latham, one on adjudication and the other on payment. Their recommendations were the subject of the report delivered by Sir Michael to the government on 20 September 2004. As part of this exercise, TeCSA produced a report on the case law under the Act.

A copy of the report to the government, and other related information is to be found on the DTI website.

It remains to be seen what, if any, changes to the Act will be made by Parliament. TeCSA will continue to monitor developments, working in the best interests of its members and their clients.
